1. Acceptance of Terms

By accessing or using Eisphora ("the Service"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, do not use the Service.

2. Description of Service

Eisphora provides a real-time options analytics dashboard displaying gamma exposure (GEX), key levels, regime detection, and other derivatives analytics for BTC and ETH markets. The Service is offered on a paid subscription basis.

3. Account Registration

To use the Service, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years old to create an account.

4. Subscription and Payment

  • Pricing: The Service is available through monthly ($29/month) or yearly ($249/year) subscription plans.
  • Payment Methods: We accept credit/debit cards (via Stripe) and cryptocurrency payments (BTC, ETH, USDT via NOWPayments).
  • Recurring Billing: Card-based subscriptions automatically renew at the end of each billing period unless canceled. Cryptocurrency subscriptions do not auto-renew.
  • Cancellation: You may cancel your subscription at any time through the billing page or Stripe Customer Portal. Access continues until the end of the current billing period.
  • Refunds: All payments are non-refundable, except as required by applicable law.

5. Acceptable Use

You agree not to:

  • Share your account credentials with third parties.
  • Resell, redistribute, or republish the data provided by the Service.
  • Use automated tools (bots, scrapers) to extract data from the Service.
  • Attempt to circumvent subscription restrictions or access controls.
  • Use the Service for any illegal purpose.

6. Intellectual Property

All content, features, and functionality of the Service — including the analytics engine, user interface, and documentation — are owned by Eisphora and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without prior written consent.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EISPHORA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO TRADING LOSSES.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. Data feeds depend on third-party providers (Deribit) and may experience delays or outages.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. Material changes will be communicated via email or a notice on the website.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation before pursuing formal proceedings.
